General Terms and Conditions of e-mediaweb.nl B.V.

Article 1 – Definitions
====================
In these terms and conditions, the following definitions apply:

e-mediaweb.nl B.V.: the company that offers products and/or services remotely to consumers.
*

Consumer: the natural person who is not acting in the exercise of a profession or business and enters into a distance contract with e-mediaweb.nl B.V.


*Distance contract: a contract concluded within the framework of an organised system for the remote sale of products and/or services by e-mediaweb.nl B.V., whereby, up to and including the conclusion of the contract, exclusive use is made of one or more means of distance communication.
*

Means of distance communication: any method that can be used for concluding a contract without the consumer and e-mediaweb.nl B.V. being physically present in the same location at the same time.


*Cooling-off period: the period within which the consumer can make use of the right of withdrawal.


*Right of withdrawal: the consumer’s right to withdraw from the distance contract within the cooling-off period.

*
Day: working day.
*

Duration transaction: a distance contract relating to a series of products and/or services, for which the delivery and/or purchase obligation is spread over time.

*
Durable medium: any tool that enables the consumer or e-mediaweb.nl B.V. to store information personally addressed to them in a way that allows future reference and unaltered reproduction of the stored information.

Article 2 – Identity of e-mediaweb.nl B.V.

Article 3 – Applicability
====================
1. These general terms and conditions apply to every offer from e-mediaweb.nl B.V. and to every distance contract concluded between e-mediaweb.nl B.V. and the consumer.

2. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed, before the distance contract is concluded, that the general terms and conditions are available upon request and will be sent free of charge as soon as possible.
3. If the distance contract is concluded electronically, then, contrary to the previous paragraph and before the contract is concluded, the text of these general terms and conditions may be provided electronically to the consumer in such a way that it can be easily stored by the consumer on a durable medium. If this is not reasonably possible, it will be indicated before the contract is concluded where the general terms and conditions can be accessed electronically and that they will be sent electronically or otherwise, free of charge, at the consumer’s request.
4. In the event that, in addition to these general terms and conditions, specific product or service terms and conditions apply, the second and third paragraphs apply accordingly, and in case of conflicting conditions, the consumer may always rely on the provision that is most favourable to them.

Article 4 – The Offer
====================
1. If an offer has a limited validity period or is made subject to conditions, this will be explicitly stated in the offer.
2. The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to allow the consumer to properly assess the offer. If e-mediaweb.nl B.V. uses images, these are a truthful representation of the products and/or services offered. Obvious mistakes or errors in the offer do not bind e-mediaweb.nl B.V.
3. The offer includes information that makes it clear to the consumer what their rights and obligations are upon acceptance, in particular:
the price, including taxes;
any delivery costs;
how the contract will be concluded and what actions are required;
whether the right of withdrawal applies;
the method of payment, delivery, or performance of the agreement;
the acceptance period of the offer, or the period during which the price will be honoured;
the rate for distance communication if it differs from the base rate;
whether the contract will be archived and how it can be accessed;
how the consumer can rectify input errors before concluding the contract;
the languages in which the contract can be concluded;
the codes of conduct to which e-mediaweb.nl B.V. subscribes and how the consumer can consult them electronically;
the minimum duration of the distance contract if it involves continuous or periodic delivery.

Article 5 – The Agreement
====================
1. The agreement is concluded, subject to the provisions in paragraph 4, when the consumer accepts the offer and complies with the associated conditions.
2. If the consumer accepts the offer electronically, e-mediaweb.nl B.V. will promptly confirm receipt of acceptance electronically. Until this confirmation is received, the consumer may dissolve the agreement.
3. If the agreement is concluded electronically, e-mediaweb.nl B.V. will take appropriate technical and organisational measures to secure the electronic transfer of data and ensure a secure web environment. If the consumer can pay electronically, e-mediaweb.nl B.V. will take appropriate security measures.
4. e-mediaweb.nl B.V. may, within legal limits, obtain information about the consumer’s ability to meet their payment obligations and about other facts and factors relevant to responsibly entering into the distance contract. If there are valid grounds not to conclude the contract, e-mediaweb.nl B.V. is entitled to refuse an order or application or to attach special conditions to its execution.
5. e-mediaweb.nl B.V. will provide the following information in writing or in a way that allows the consumer to store it on a durable data carrier along with the product or service:

Article 6A – Right of Withdrawal for Product Deliveries
====================
1. When purchasing products, the consumer has the right to dissolve the contract without giving any reason within 14 days. This period starts on the day after the consumer, or someone on their behalf, receives the product.
2. During this period, the consumer will handle the product and packaging with care. They will only unpack or use the product to the extent necessary to determine whether they wish to keep it. If they exercise the right of withdrawal, they will return the product with all supplied accessories and, if reasonably possible, in its original condition and packaging to e-mediaweb.nl B.V., in accordance with the reasonable and clear instructions provided by e-mediaweb.nl B.V.

Article 6B – Right of Withdrawal for Service Deliveries
====================
1. When services are provided, the consumer has the right to dissolve the contract without giving any reason within 14 days, starting from the day the contract is concluded.
2. To exercise the right of withdrawal, the consumer shall follow the reasonable and clear instructions provided by e-mediaweb.nl B.V. at the time of the offer and/or at the latest upon delivery.

Article 7 – Costs in Case of Withdrawal
====================
1. If the consumer exercises the right of withdrawal, the cost of returning the goods shall be borne by the consumer.
2. If the consumer has made a payment, e-mediaweb.nl B.V. will refund this amount as soon as possible, but no later than 14 days after the return or withdrawal.

Article 8 – Exclusion of the Right of Withdrawal
====================
1. If the consumer does not have a right of withdrawal, e-mediaweb.nl B.V. can only exclude it if e-mediaweb.nl B.V. clearly stated this in the offer, at least in good time before the conclusion of the contract.
2. Exclusion of the right of withdrawal is only possible for products:
- produced by e-mediaweb.nl B.V. according to the consumer’s specifications;
- clearly personal in nature;
- that, by their nature, cannot be returned;
- for audio and video recordings and computer software where the consumer has broken the seal;
- for e-books and audiobooks.

Article 9 – The Price
====================
1. During the validity period stated in the offer, the prices of the offered products and/or services will not be increased, except for changes due to VAT rate changes.
2. Contrary to the previous paragraph, e-mediaweb.nl B.V. may offer products or services whose prices are subject to fluctuations in the financial market and over which e-mediaweb.nl B.V. has no influence, at variable prices. This link to fluctuations and the fact that any stated prices are target prices will be stated in the offer.
3. Price increases within 3 months after the conclusion of the agreement are only allowed if they are the result of legal regulations or provisions.
4. Price increases from 3 months after the conclusion of the agreement are only allowed if e-mediaweb.nl B.V. has stipulated this and:
- they are the result of legal regulations or provisions; or
- the consumer has the right to terminate the contract as of the day the price increase takes effect.
5. The prices stated in the offer of products or services include VAT.

Article 10 – Conformity and Warranty
====================
1. E-mediaweb.nl B.V. guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability, and the legal provisions and/or government regulations in force on the date of conclusion of the agreement.
2. Any warranty arrangement offered by e-mediaweb.nl B.V., the manufacturer, or importer does not affect the legal rights and claims the consumer may assert against e-mediaweb.nl B.V. for any failure to fulfill its obligations under the agreement and/or the law.
3. Damage to the product caused by external factors, such as drops, impacts, pressure on the screen, or other forms of improper use, is not covered by the warranty. This includes, but is not limited to, broken e-ink displays. Such damage is considered user damage and is not eligible for free repair or replacement under warranty.
4. If an order is delivered defective, the defect must be reported to e-mediaweb.nl B.V. by e-mail within 24 hours, including a description of the defect and photos of the defect as well as all packaging materials. If possible, the report should be made to the delivery driver, or the delivery should be refused.

ARTICLE 11 – Delivery and Execution
====================
1. E-mediaweb.nl B.V. will exercise the greatest possible care when receiving orders for products and when executing product deliveries, as well as when assessing requests for the provision of services.
2. The place of delivery is deemed to be the address provided by the consumer to the company.
3. Subject to the provisions of Article 4 of these General Terms and Conditions, the company will execute accepted orders with due speed but no later than within 30 days, unless a longer delivery period has been agreed. If delivery is delayed, or if an order cannot be fulfilled or can only be partially fulfilled, the consumer will be notified of this no later than one month after placing the order. In such a case, the consumer is entitled to dissolve the agreement without costs and is entitled to possible compensation.
4. In the event of dissolution in accordance with the previous paragraph, e-mediaweb.nl B.V. will refund the amount paid by the consumer as soon as possible, but no later than 10 days after dissolution.
5. If delivery of an ordered product proves impossible, e-mediaweb.nl B.V. will make every effort to provide a replacement item. No later than at the time of delivery, it will be clearly and understandably communicated that a replacement item is being delivered. The right of withdrawal may not be excluded for replacement items. The cost of returning such items will be borne by e-mediaweb.nl B.V.
6. The risk of damage to and/or loss of products remains with e-mediaweb.nl B.V. until the moment of delivery to the consumer, unless expressly agreed otherwise.

ARTICLE 12 – Long-term Transactions
====================
1. The consumer may terminate an agreement entered into for an indefinite period at any time, subject to the agreed termination rules and a notice period of no more than one month.
2. An agreement entered into for a fixed period has a maximum duration of two years. If it has been agreed that the distance contract will be tacitly renewed if the consumer remains silent, the agreement will be continued as an agreement for an indefinite period, and the notice period after continuation will be a maximum of one month.

ARTICLE 13 – Payment
====================
1. Unless otherwise agreed, the amounts owed by the consumer must be paid within fourteen days after the delivery of the goods, or, in the case of an agreement to provide a service, within 14 days after the delivery of the relevant documents.
2. In the sale of products to consumers, the general terms and conditions may never stipulate an advance payment of more than 50%. When an advance payment has been agreed, the consumer may not assert any rights regarding the execution of the relevant order or service(s) before the agreed advance payment has been made.
3. The consumer is obliged to immediately report any inaccuracies in payment details provided or stated to e-mediaweb.nl B.V.
4. In the event of non-payment by the consumer, and subject to legal restrictions, e-mediaweb.nl B.V. has the right to charge the consumer reasonable costs communicated in advance.

ARTICLE 14 – Complaints Procedure
====================
1. E-mediaweb.nl B.V. has a complaints procedure that has been made sufficiently known and will handle complaints in accordance with this complaints procedure.
2. Complaints about the execution of the agreement must be submitted to e-mediaweb.nl B.V. within a reasonable time after the consumer has discovered the defects, and must be complete and clearly described.
3. Complaints submitted to e-mediaweb.nl B.V. will be answered within 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, e-mediaweb.nl B.V. will respond within 14 days with an acknowledgment of receipt and an indication of when the consumer can expect a more detailed response.

ARTICLE 15 – Additional or Deviating Provisions
====================
Additional provisions or provisions deviating from these general terms and conditions shall not be to the detriment of the consumer and must be recorded in writing or in such a way that they can be stored by the consumer in an accessible manner on a durable medium.

ARTICLE 16 – Amendment of the General Terms and Conditions
====================
Amendments to these terms and conditions shall only take effect after they have been published in an appropriate manner, it being understood that in the event of applicable amendments during the term of an offer, the provision most favorable to the consumer will prevail.

ARTICLE 17 – WEEE Registration Number and Battery Registration Number
====================
In accordance with regulations regarding the waste management of electrical and electronic equipment (WEEE) and batteries, we hereby inform you as follows:

17.1 WEEE Registration Number  
Our company is registered in the national register for the waste management of electrical and electronic equipment under WEEE registration number: DE 11083352.

17.2 Battery Registration Number  
We also comply with the legal obligations for the collection and recycling of batteries and accumulators. Our company is registered in the national batteries register under Battery Registration Number: DE 62010382.

These registration numbers confirm that we comply with the relevant legislation for the collection, processing, and recycling of electrical and electronic equipment and batteries.
